ARTICLE 1 – PURPOSE These General Terms and Conditions of Sale (“T&Cs”) govern all sales entered into between PETRALITHE and any buyer, whether a professional or a consumer, regardless of the ordering method, including via the website www.petralithe.com, by email, by phone, through a signed quotation, or under a distribution agreement. Placing an order implies the Buyer’s full and unreserved acceptance of these T&Cs, to the exclusion of any other document such as catalogues or brochures issued by PETRALITHE, which are provided for information purposes only. No special conditions may, unless formally accepted in writing by PETRALITHE, prevail over these T&Cs.
ARTICLE 2 – PRODUCTS
PETRALITHE designs, manufactures, and sells hand-painted decorative wall panels, made to order in its workshop in Auvergne using a patented process. PETRALITHE also sells complementary accessories (adhesive, touch-up kit, lighting, etc.).
The essential characteristics of the products are described on the relevant product information sheets. Variations in shade, texture, or finish resulting from artisanal production cannot be considered defects.
ARTICLE 3 – ORDERS
Any order is deemed firm once it has been confirmed in writing (email confirmation, signed quotation, purchase order, or payment). Once production has started, no modification or cancellation may be accepted without PETRALITHE’s prior written approval.
PETRALITHE reserves the right not to record a payment and not to confirm an order for any reason, in particular in the event of supply issues or difficulties related to the order received.
For online orders, an order summary is sent automatically. For offline orders, validation of the quotation or purchase order binds the customer in the same way.
ARTICLE 4 – ORDER CONFIRMATION
Confirmation of an order by the customer constitutes full acceptance of these T&Cs. All data provided and the recorded confirmation shall constitute proof of the transaction. The order confirmation constitutes signature and acceptance of the transactions carried out. An order summary will be sent by email.
ARTICLE 5 – PRICES
Prices are indicated in euros, inclusive of all taxes (VAT included) unless otherwise stated, and excluding processing and shipping costs. Shipping costs are specified before the order is validated.
PETRALITHE reserves the right to change its prices at any time. However, products are invoiced at the price in force at the time the order is placed.
The products remain the property of PETRALITHE until full payment of the order has been received.
From the moment the products are physically handed over to the customer or to their carrier, the risks of loss or damage to the products are transferred to the customer.
ARTICLE 6 – AVAILABILITY
Our products are offered for sale as long as they are displayed on the Website and subject to available stock. For made-to-order or non-stocked products, offers are subject to the availability of raw materials. In the event of unavailability after an order is placed, PETRALITHE will inform the customer and offer either a refund or an alternative solution. PETRALITHE also reserves the right to refuse orders for an excessively large quantity of identical items placed at one time.
ARTICLE 7 – PAYMENT
Payment is due at the time of order, either by standard bank transfer or via one of the payment methods offered on the Website. Payments are processed through third-party providers, subject to their own terms and conditions.
ARTICLE 8 – PRODUCTION AND LEAD TIMES
PETRALITHE panels are made to order. The average dispatch time is 3 to 4 weeks from order confirmation. This timeframe is indicative and depends on production workload. Any delay shall not give rise to compensation or order cancellation, unless expressly agreed otherwise in writing.
Accessories offered for sale are not made to order and are generally available from stock. However, when an order includes both made-to-order panels and in-stock accessories, the entire order will be shipped in a single delivery once the panels are ready.
To receive accessories sooner, the buyer must place two separate orders.
ARTICLE 9 – DELIVERY
Delivery is made to the address provided by the customer. Depending on the quantity and type of products ordered, delivery may be made in individual boxes or on a pallet. Delivery is free in mainland France from a certain number of panels, as specified on the Website.
A valid phone number is required so that the carrier can contact you. A phone call or email is generally used to schedule delivery. However, this process depends on the carrier’s organisation and cannot be guaranteed.
Additional charges may apply if you do not follow the carrier’s instructions, in particular in the event of absence at the agreed delivery appointment.
Delivery is made at the building entrance or at the foot of the property. The carrier is under no obligation to deliver the products inside the building or to an upper floor. The carrier is also not required to take back packaging.
Upon delivery, you must check the condition of the goods in the presence of the carrier. If in doubt, you must write precise reservations on the delivery note (e.g., “Packages damaged”) and take photos.
For deliveries outside mainland France, shipping is not automatically offered on our Website. However, you may contact us to arrange a customised shipment. Additional charges may apply. Customs duties and local taxes are the customer’s responsibility.
ARTICLE 10 – RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to made-to-order or personalised products. Returns are accepted only in the event of a defect observed upon delivery and validated by our team. Any return requires prior authorisation.
For standard products that are not made to order, the customer has a period of 14 days from receipt to exercise the right of withdrawal. Return shipping costs are borne by the customer. A refund will be issued after receipt and inspection of the returned product(s).
The right of withdrawal does not apply to goods unsealed by the consumer after delivery, goods that are inseparably mixed with other items, or goods likely to deteriorate rapidly.
The right of withdrawal under the French Consumer Code applies only to consumers. Professionals, defined as any legal entity or individual acting in the course of their business activity, are not entitled to it.
ARTICLE 11 – WARRANTY
All products supplied by PETRALITHE benefit from the statutory warranty provided for under Articles 1641 et seq. of the French Civil Code.
In the event of non-conformity of a product sold, the product may be returned to PETRALITHE, which will, as applicable, proceed with an exchange, repair, or refund.
All complaints, requests for exchange, or refund must be made in writing and sent by post to the following address: PETRALITHE – 257 Rue Albert de Dion, 63500 Issoire, France, within thirty (30) days of delivery.
ARTICLE 12 – LIABILITY
PETRALITHE declines all liability in the event of misuse, non-compliant installation, product modification, or damage resulting from improper storage. It is the buyer’s responsibility to ensure that the products are suitable for their project.
In the context of online sales, the seller is subject only to a best-efforts obligation. The seller’s liability cannot be incurred for any damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other unintentional issues.
ARTICLE 13 – INTELLECTUAL PROPERTY
The manufacturing process used for the panels is protected by a filed patent. Any use or exploitation of this process without authorisation constitutes infringement and may give rise to legal proceedings.
PETRALITHE designs are protected under applicable laws. Any unauthorised reproduction, representation, or commercial use is strictly prohibited.
All elements of the Website… www.petralithe.com are and remain the exclusive intellectual property of PETRALITHE. No one is authorised to reproduce, exploit, or use all or part of the Website without PETRALITHE’s prior written consent.
ARTICLE 14 – FORCE MAJEURE
PETRALITHE shall not be held liable in the event of force majeure or any event beyond its control preventing the performance of its obligations (strike, damage, supply disruption, etc.).
ARTICLE 15 – APPLICABLE LAW AND JURISDICTION
These T&Cs are governed by French law. The contract language is French. In the event of a dispute not resolved amicably, the competent court shall be the courts of Clermont-Ferrand, including in the event of multiple defendants or third-party proceedings.
ARTICLE 16 – PERSONAL DATA
PETRALITHE reserves the right to collect nominative information and personal data relating to its customers. This data is necessary for order management, service improvement, and the communication of personalised information.
This data may also be shared with service providers involved in the performance of services, such as those responsible for shipping, processing, or payment. It is also retained for security purposes and to meet legal and regulatory obligations.
In accordance with the French “Data Protection Act” of 6 January 1978 as amended and the General Data Protection Regulation (GDPR), the customer has the right to access, rectify, erase, and object to the processing of personal data concerning them. If you do not wish your data to be used for commercial prospecting purposes, simply let us know by email at the same address.
ARTICLE 17 – PROMOTIONAL OFFERS
Promotional offers are exceptional in nature. The prices set during such offers are valid only for the periods indicated. No discount may be claimed outside these promotional periods.
ARTICLE 18 – SAFETY DATA SHEETS
In accordance with applicable regulations, Safety Data Sheets (SDS) for the relevant products are available free of charge upon request by email via our online contact form.
